Liberonym

Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of Liberonym (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

The Service is operated by Liberonym. Liberonym is currently provided as a controlled beta. Where a legal entity is established or designated as the operator and data controller, the relevant operator and controller information in these Terms and in the Privacy Policy will be updated accordingly.

2. What Liberonym is — and what it is not

Liberonym is a preliminary screening and decision-support service. It searches sources that it is able to search, presents observations with their evidence, and helps you understand what those observations may mean for a naming decision. You make the decision.

Liberonym does not:

  • provide legal advice, legal opinions or trademark clearance;
  • act as a law firm, trademark attorney, branding agency, domain registrar or registry;
  • file, prosecute, oppose or maintain any registration on your behalf;
  • guarantee that a name is available, registrable, lawful or free of third-party rights.

No lawyer–client relationship is created by your use of the Service, by the delivery of any report, or by any communication with Liberonym.

2.1 Given and family name usage

Where Liberonym reports that a name, or a component of it, is recorded as a given name or a surname, it is reporting a name recorded in published official name data — nothing more. Liberonym analyses names, not people.

The Service is not, and must not be used as, a means to:

  • find, identify, profile or investigate any individual;
  • connect a given name and a surname into a person, or determine that a particular person uses a name;
  • perform people search, genealogy, identity verification or background checks;
  • infer origin, ethnicity, race, religion, nationality, political opinion, health, sexual orientation, family relationship, immigration status or any other personal characteristic from a name.

Such use is a breach of these Terms. Name-usage observations are informational context only. They are not a legal finding, and they do not address personality rights, publicity rights, image rights or the rights of any named individual, which are outside the scope of the Service. Because published name data covers only what each authority chose to publish, Liberonym reports only what it positively found; the absence of a name-usage observation is not a statement that a name is unused.

3. The nature of results

  • The absence of a finding does not establish the absence of rights. A report reflects what was found in the sources searched, at the time they were searched.
  • An inability to check a source is not a negative result. Where a source could not be read on a run, or is not currently covered, the report says so plainly using the statuses set out in section 3.1, and that statement must not be read as a clear result.
  • Potentially relevant trademark findings require professional legal review before you proceed.
  • A clean preliminary result remains preliminary. Professional clearance remains recommended before filing an application or making a material commercial commitment.
  • Company-name and business-name checks are not trademark clearance, and domain or social handle availability is not legal availability.
  • Reports describe a moment in time. External data changes, and a report can become outdated.

Further detail is set out in the Legal & Professional Disclaimer, which forms part of these Terms.

3.1 Liberonym search and coverage statuses

Liberonym uses different status labels to communicate what happened during a check.

A status of “No observations identified” means only that no relevant observations were identified through the applicable check. It does not establish that no conflicting right, restriction or risk exists, that every possible source was searched, that the name is available or registrable, or that further investigation is unnecessary where the circumstances warrant it.

“Unable to verify”, “Couldn't check” and “Not currently covered” are not clean results and must not be interpreted as confirmation that no relevant issue exists.

“In progress” means that processing has not yet finished and is not a final outcome.

Where “Observations identified” is shown, the observations should be considered in their relevant context. The existence of an observation does not by itself establish that a legal conflict or prohibition exists.

The legal significance of any observation depends on the relevant facts, jurisdiction and circumstances and may require professional review.

4. Artificial intelligence

Parts of the Service use artificial intelligence and automated processing to organise, summarise, translate and present information. AI-assisted outputs are not legal determinations and may contain errors or omissions. You should not rely on them as a substitute for professional advice. See the AI & Data Transparency Notice.

5. Accounts

You may run an evaluation without an account. Creating an account lets you save evaluations and open them again on any device. You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be old enough to enter into a binding contract in your country of residence, and the Service is not directed at children.

Running an evaluation is separate from saving it. An evaluation is only added to your account history when you choose to save it.

Account deletion. You may request or initiate deletion of your account at any time from your account settings. On deletion we remove or de-identify account-related personal information and saved content, and revoke associated shared access, subject to information Liberonym is legally permitted or required to retain (for example for security, fraud prevention, legal claims, contractual evidence, accounting or tax). Residual copies may persist in secure backups until they age out under the normal backup lifecycle.

6. Acceptable use

Your use of the Service is subject to the Acceptable Use Policy, which forms part of these Terms. Personal, business, professional and authorised client use are all permitted within your applicable plan terms.

7. Your content and your names

You retain all rights you have in the names, descriptions and other material you submit. Liberonym does not acquire ownership of proposed names merely because you submit them to the Service. You grant Liberonym only the limited licence necessary to operate the Service for you — to process, store, analyse and display your material so that we can produce and deliver your reports, and to comply with law.

You are responsible for having the right to submit what you submit, and for your use of any name you choose.

8. Liberonym’s intellectual property and confidential technology

The Service, its interfaces, content, structure, reports (excluding your own material) and underlying technology are protected by intellectual property rights and are licensed, not sold. You receive a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.

Nothing in these Terms grants access to or rights in Liberonym’s confidential technology, intellectual property, proprietary systems or internal processes. Liberonym is under no obligation to disclose them, and their confidentiality does not reduce the transparency we provide about what the Service does and where information came from.

9. Paid services, cancellation and refunds

Some features may be offered on a paid basis. Where they are, the price, billing period, renewal behaviour and what is included will be presented clearly before you purchase, and those purchase terms form part of the agreement between us.

Consumers. Where you contract as a consumer, your statutory rights apply, including any applicable right of withdrawal within the statutory period. Where a digital service begins immediately at your express request and you acknowledge that the right of withdrawal is lost once the service has been fully performed, that acknowledgement will be obtained explicitly at the point of purchase. Nothing in these Terms limits or excludes mandatory consumer rights.

Business Users. Where you contract other than as a consumer, statutory consumer withdrawal rights do not apply, and cancellation takes effect in accordance with the applicable purchase terms.

You may cancel a recurring plan at any time; cancellation stops future renewals and takes effect at the end of the paid period unless stated otherwise. Taxes may apply.

10. Marketing communications

Where Liberonym offers optional marketing communications, they are subject to applicable marketing and privacy requirements. Marketing consent is separate from acceptance of these Terms and cannot be required merely to use the Service. You may withdraw it at any time without affecting ordinary functionality. Transactional, authentication, security and service messages are not marketing and are sent as part of providing the Service.

11. Availability and changes

Liberonym is provided on an ongoing but evolving basis. Sources, coverage and features may be added, changed, paused or removed. We may suspend access where necessary for security, legal or operational reasons. We may update these Terms; where a change is material we will take reasonable steps to bring it to your attention, and continued use after a change takes effect means you accept the updated Terms.

12. Limitation of liability

Liability is addressed in the standalone Limitation of Liability page, which forms part of these Terms. Mandatory consumer rights remain unaffected.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access where these Terms or the Acceptable Use Policy are breached, where required by law, or where continued provision is not reasonably possible. Provisions that by their nature should survive termination will survive.

14. Contact

Questions about these Terms can be sent through the contact page.
